Lindsay Lohan

A Los Angeles Superior Court judge ruled Thursday that Lindsay Lohan did not violate probation by consuming alcohol because it was not part of her probation requirements.
But the judge forbade the actress -- who recently held a party on the roof of her Venice home -- from having more than one person there unless it was for family or business reasons.
The judge said the alcohol test administered last week by probation officers was not required.
Shawn Holley, Lohan's attorney, said: "She didn't do anything wrong. It wasn't a violation for her to drink. The headline should read that she did not have a probation violation."
Judge Stephanie Sautner said she and the attorneys went through Lohan's court file and discovered the  last order only applied to drugs and alcohol consumed from Jan. 3 to Feb. 25.
"You are not guilty of a probation violation, but what you are guilty of is extremely poor judgment," Sautner told Lohan. "You are not to have parties. You are to have one friend over at a time, plus family and business dealings."
L.A. County Superior Court Judge Eldon Fox ordered the drug tests earlier this year, but the time frame had already lapsed.
"I don't think there is ambiguity in that wording," Sautner said Thursday.
Sautner said she was not happy with house detention but could not discontinue it without cause.
Lohan was ordered to court Thursday because of the alcohol test, which was thought to have violated terms of her probation for a 2007 drunk-driving conviction.
Lohan is also on probation for allegedly stealing a necklace in January from a Venice jewelry store. She is serving about 35 days under house arrest on the conviction.
